A lawsuit was filed in LA by Givenchy against BCBG Max Azria over what those familiar with legal terms will understand as Trade Dress. Trade Dress pretty much means that designers have the right to protect their products and packaging from being copied in terms of color schemes, sizes, textures, graphics, decorations etc. For example: note the bag’s stitching and handle shape.
According to a legal blog, “BCBG is accused of trying to profit from Givenchy’s goodwill by selling “its knock-off ‘Rembrandt’ and other handbags that deliberately copy, line-by-line and stitch-by-stitch distinctive, non-functional elements of Givenchy’s Nightingale Trade Dress.”
